Terms of Service
These terms cover access to the LMBYW managed platform and related website services, including scope, billing, cancellation, and responsibility.
1. Who we are
This website, the LMBYW managed platform and the related website services described here are operated by Let Me Build Your Website (“LMBYW”, “we”, “us”), a managed Software-as-a-Service (SaaS) / Website-as-a-Service (WaaS) provider based at B143 L21 Branco St., Brook Village, The Villages, Lima Estate, Lipa City, Batangas, Philippines.
You can reach us at info@letmebuildyourwebsite.com or 0962 098 7437.
2. What we provide
LMBYW provides businesses with access to a managed Software-as-a-Service (SaaS) / Website-as-a-Service (WaaS) platform. Depending on the agreement with you, a subscription may include:
- Client account and portal access
- Billing and subscription access
- Support communication through the platform
- Managed website hosting and infrastructure administration
- Platform maintenance, monitoring and technical troubleshooting
- Domain and DNS administration, where we agree to manage it
- Related ongoing website operations agreed in writing
Website design, development, setup, migration, deployment, content work or other custom implementation may also be agreed separately. Those services are related to the platform but are not necessarily included in the recurring subscription.
3. Your scope and price are yours
We do not sell identical subscriptions at a single fixed price. Your subscription scope, website scope, agreed amount and monthly or annual billing interval are defined with you before billing begins.
Nothing on this website is a universal price. Any figures we publish are examples or ranges. Your price is the one stated in your own agreement or in the checkout you are asked to approve.
Separate implementation, setup, design or development fees may also apply. Any such fees and their scope are agreed case by case before the applicable work begins.
4. Recurring billing
The LMBYW managed platform subscription is billed automatically on the monthly or annual cycle stated in your agreement and shown to you at checkout before you approve it. The subscription renews and the agreed charge repeats each cycle until it is cancelled.
You are responsible for keeping a valid payment method on file and for paying the amounts due for your subscription and any separately agreed services.
5. Payments and Merchant of Record
For transactions processed through Paddle, the order process is conducted by our online reseller, Paddle.com. Paddle is the Merchant of Record and seller of record for those transactions. Paddle handles payment processing, receipts and invoices, applicable tax calculation and collection, and transaction-related billing and refund processing.
Purchases made through Paddle are also subject to Paddle’s own buyer terms and refund policy, in addition to these terms.
LMBYW remains responsible for providing and supporting the LMBYW managed platform and related website service. Paddle does not provide product or technical support for the LMBYW platform.
We never receive or store your full card number or security code. Card details are handled entirely by the payment provider.
6. Cancelling your service
You can cancel a recurring service at any time by contacting us at info@letmebuildyourwebsite.com, or by using the cancellation link provided by the payment provider for your subscription.
Cancellation stops future renewals. Unless we agree otherwise in writing, your service continues until the end of the billing period you have already paid for, and is not renewed after that.
Cancelling does not by itself refund a payment that has already been taken. See our Refund Policy.
7. Unpaid invoices
If a payment fails, the payment provider will normally retry it and contact you. We will not suspend access to the platform or a managed website because of a single failed payment.
If payment remains unresolved after we have contacted you and given you a reasonable opportunity to fix it, we may suspend the service until the account is brought up to date. We will tell you before we do this.
8. What you are responsible for
You are responsible for the material you give us. By providing it, you confirm that:
- The text, images, logos, menus, prices and business information you supply are accurate
- You have the right to use and publish that material, including any photographs and fonts
- You will keep any access credentials we give you confidential
- You will tell us promptly if your business details change in a way that affects the website
9. Intellectual property
Your brand, content and business information remain yours. Our own tools, internal components and working methods remain ours.
Ownership of the finished website, its source code, and any domain we register or manage on your behalf is set in the agreement we make with you. Different clients arrange this differently, so we do not state a single rule here. If you are unsure what your agreement says, ask us and we will confirm it in writing.
10. Third-party services
Operating the LMBYW platform and delivering the related website service involves providers we do not control, including hosting and infrastructure providers, domain registrars, payment providers such as Paddle, and analytics tools. Those providers have their own terms, and their availability and behaviour are outside our control.
11. Acceptable use
You may not use our service to publish or distribute:
- Anything illegal under Philippine law or the law that applies to you
- Material that infringes someone else’s rights
- Deceptive, fraudulent or deliberately misleading claims
- Malware, or anything designed to damage or gain unauthorised access to systems
- Anything prohibited by our payment provider’s acceptable use policy
We may suspend or end a service that breaches this section, and we may be required to do so by our providers.
12. Availability
We work to keep the LMBYW platform and the websites we manage available and functioning, and we monitor them. We do not guarantee uninterrupted or error-free service.
We do not offer a guaranteed uptime percentage or a formal service level agreement unless one is expressly written into your own agreement. Hosting outages, domain issues, third-party failures and scheduled maintenance can all cause downtime.
13. Limitation of liability
We provide our service with reasonable care and skill. To the extent permitted by law, we are not liable for indirect or consequential losses, including lost profits, lost business or lost data, arising from the use of or inability to use the LMBYW platform or a website we manage.
Where we are found liable, our total liability for any claim is limited to the amount you paid us for the service in the three months before the event that gave rise to the claim.
Nothing in these terms limits any liability that cannot be limited by law, including rights you have under mandatory Philippine consumer protection law.
14. Ending the relationship
You may cancel as described in section 6. We may end a service by giving you reasonable notice, or immediately if you breach section 11 or if a provider requires it.
When a service ends, access to the platform will end in accordance with your agreement. We will discuss with you what happens to the website, its content and any domain. Ask us before you cancel if you want this confirmed in writing first.
15. Changes to these terms
We may update these terms as the service changes. The current version is always published on this page with the date it was last updated. Where a change materially affects an active subscription, we will make reasonable efforts to tell you.
16. Governing law
These terms are governed by the laws of the Republic of the Philippines. This does not remove any protection available to you under the law of the country where you live.
